Terms of Service

These Terms of Service ("Terms") govern your access to and use of PIXELFALLS websites and services, including the marketing site, IDE, player, and related apps (the "Services"), operated by PIXELFALLS ("we", "us", or "our").
By creating an account, accepting an in-product notice, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Please also read our Privacy Policy.
These Terms are a product document and should be reviewed by a solicitor before relying on them for a public commercial launch. Governing law is intended to be England and Wales.
1. Early access / alpha
- PIXELFALLS is provided as early access / alpha software. Features may change, break, or be withdrawn without notice.
- The Services are offered primarily for testing, learning, and feedback. Do not rely on them as a production or mission-critical platform.
- We may use anonymised or attributed feedback you provide to improve and promote PIXELFALLS.
2. Accounts
- You must provide accurate account information and keep your login credentials confidential.
- You are responsible for activity under your account.
- Guest mode stores projects in the browser only. Clearing site data, using private browsing, or switching devices can cause loss of work unless you export a cart or create an account and save to the cloud.
- You may delete your account in the IDE (Account settings). Deletion removes cloud games and cancels an active subscription as described in the product UI; some billing records may remain with Stripe.
3. Your content
- You retain ownership of games, code, art, audio, and other content you create ("User Content").
- You grant us a worldwide, non-exclusive licence to host, store, transmit, and display User Content as needed to operate the Services (including cloud save and publishing features you enable).
- You must not upload unlawful, infringing, or harmful content, or misuse the Services to attack others or circumvent security.
- PIXELFALLS (the platform, branding, engine, and our original materials) remains our intellectual property.
4. Cloud save and publishing
- Cloud storage is subject to plan limits and fair use.
- Published games may be publicly accessible via the player or share links you create. You are responsible for what you publish.
- We recommend regularly exporting PNG carts as backups. Alpha software and cloud services can fail; we are not liable for lost work beyond what the law requires.
5. Plans, billing, and cancellation
- Paid tiers are billed through Stripe. Prices and entitlements are shown in the IDE billing UI and may change for future renewals with notice where required.
- You can manage or cancel a subscription via the billing flows in the IDE (including Stripe Customer Portal where offered). Cancellation typically takes effect at the end of the current billing period unless stated otherwise.
- Downgrades may be blocked if your stored cloud data exceeds the target plan's quota — free up storage first.
- Refunds are handled case-by-case and may be limited by Stripe/processor rules and applicable consumer law.
6. Acceptable use
You agree not to:
- Share accounts or credentials;
- Attempt unauthorised access to the Services or other users' data;
- Reverse engineer or abuse the Services except as allowed by law;
- Use the Services for unlawful, harassing, or abusive purposes;
- Overload or disrupt infrastructure (scraping, spam, or similar abuse).
7. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that data will never be lost.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of (a) the amounts you paid us for the Services in the 12 months before the claim, or (b) £50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or fraud).
9. Changes
We may update these Terms as the product evolves. Material changes may be highlighted in-product or on the site. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections that apply where you live.
